German Tax Returns for Individuals and Sole Traders (Gewerbe)

We help assemble records of employment, business or rental income in Germany and coordinate preparation of returns by an authorised tax partner. Optima Prime organises documents, communication and administrative support. Individual tax advice, preparation of German tax returns and representation in tax matters are provided by appropriately authorised partners.

Who is required to file a return

The obligation to file depends on the types of income and personal circumstances. It can apply to people living in Germany or abroad.

We gather information about the client’s income and circumstances. An authorised tax partner assesses which returns and actions are required.

Tax returns for individuals

We help collect certificates of employment income, pensions, foreign income and expenses. We organise documents concerning matters such as commuting, insurance or a second household.

An authorised partner assesses residency, eligibility for joint assessment and deductions. That partner prepares the German return and carries out any correction, appeal or representation work.

Tax returns for Gewerbe businesses (Einzelunternehmen)

We organise income, expense and investment records needed for an EÜR and Einkommensteuer, Umsatzsteuer and Gewerbesteuer returns where applicable.

An authorised tax partner is responsible for assessing and preparing the required German returns. We coordinate questions about tax planning or changes of legal form with appropriately authorised tax or legal partners.

How the filing process works

We gather information and agree a document list: certificates, invoices, contracts and payment evidence. We coordinate their handover to the authorised tax partner and responses to their questions.

The partner prepares and files German returns and assesses the tax decision and any corrections or appeals. Optima Prime supports communication and organisation of the next steps.

Frequently asked questions

Do I have to file a tax return in Germany if I live in Poland?

Yes, if you earn income taxable in Germany – for example from employment, the provision of services, rental income or business activity. The annual filing obligation (Einkommensteuererklärung) with the Finanzamt applies to German tax residents and non-residents alike. The key step is establishing your tax residency status, i.e. whether you have unlimited or limited tax liability.

Which taxes does a Gewerbe owner have to settle in Germany?

A sole trader (Gewerbe, Einzelunternehmen) files an annual income tax return (Einkommensteuer) together with an income-and-expense statement (Einnahmen-Überschuss-Rechnung – EÜR). On top of that come the annual VAT return (Umsatzsteuer-Jahreserklärung) and the trade tax return (Gewerbesteuererklärung). The return can also account for depreciation, operating costs, investments and contributions, among other things.

Can I file jointly with my spouse in Germany?

Yes – eligibility for joint assessment with a spouse (tax class III/V) depends on your circumstances and is worth verifying before you file. Your return can also include the allowances and deductible expenses available to you, such as commuting costs, per diems, the cost of maintaining a second household and insurance.

How does filing a tax return in Germany work and which documents do I need?

The process starts with an analysis of your income sources, costs and family circumstances, followed by compiling documents such as the Lohnsteuerbescheinigung, invoices, contracts, payment confirmations, insurance documents and evidence of expenses. The completed return is filed electronically with the relevant Finanzamt, which then issues a tax assessment (Steuerbescheid) showing either a refund or an additional payment. Optima Prime Consulting assembles documents and coordinates communication. German returns, corrections, appeals and representation are handled by appropriately authorised tax partners.

Who provides tax advice and represents the client?

Optima Prime organises documents, communication and administrative support. Individual tax advice, preparation of German tax returns and representation in tax matters are provided by appropriately authorised partners.
